Back when electronic discovery was still a nascent industry, judges were much more tolerant of mistakes by e-discovery vendors. The industry was still new and the courts understood there were kinks in the system that had to be worked out. Not so anymore. Today, any e-discovery vendor that fails to meet its obligations can find itself facing liability. |
